Rechtliche Relevanz und Folgen

Der PSPC-Code ist Bestandteil von SOLAS II-1/3-2 und somit ein zu erfüllender Bereich wenn es um die Erteilung des Klassezertifikates geht.

Kurz: Ist ein Schiff nicht PSPC konform gebaut, erfüllt es nicht die Anforderungen nach SOLAS und IASC und bekommt kein Klassezertifikat.

Es darf somit nicht betrieben werden!!!

offizielles Statement der IMO:

“The PSPC is mandatory under the SOLAS Convention and also under the IACS Common Structural Rules. Any ship to which the PSPC is applicable that is not built in compliance with the Standard could thus not be issued with a class certificate and would as a consequence not be able to trade internationally, since the flag State would not register the ship.
The PSPC also requires a Coating Technical File (CTF) which has to be approved by the Administration and might be subject to port State control.
Without registration, class certificate and CTF the ship would operate illegally and would not pass any PSC inspection which means it would be detained at the first point of inspection.”
